Prevention Statement
- No feedback received
EA-03 Optional Coverage
General Comments
This policy is wordy and not user friendly to read
Gaps in the Policy Proposal
Section 7 - Cancellation of Optional Coverage:
- The last bullet is very broad; consideration should be given to including criteria to clarify this statement or whether this bullet is actually needed
- Suggest providing examples of when a cancellation would occur
- The way this policy is written Optional coverage takes effect when the application is approved by the board or the date specified in the application, whichever is latest; as an employer, there can be delays in processing the application that create gaps in coverage
- Delays in processing applications are out of the control of employers; this change is unfair to employers
Additional Comments
If the coverage amount is changed or cancelled, the policy says it is dated as to the date the change request was received by the board; but the original coverage is only in effect after it is approved. These two processes should match. It should be that the original application and any changes to coverage should take effect as of the date they are received, not date by which it is approvedConsideration should be given to automatic renewals for coverage. Car insurance, commercial liability insurance, etc. all automatically renew. As a business owner not having to fill out a new application every year would save time and eliminate any gaps in coverage
EN-09 Adjudicating Psychological Injuries
General Comments
Overall this is a good policy and the specific examples are helpfulDefinition of ‘traumatic events’ – consider whether to include sexual violence/sexual trauma
Positive feedback about this policy and appreciation for the work that has gone into it

FA-06 Retirement Benefit
General Comments
Definition of ‘Appeal Tribunal’ – consider including an explanation that this definition is the same as in the Act; confusing with the term ‘continued’Section 1 – General:
- Suggest adding the wording “for the purposes of these calculations” for clarity
- Paragraph b. – suggest clarifying the wording and removing the word ‘may’
- Suggest including information that workers may be entitled to retirement benefits just so that it emphasizes the board’s responsibility to educate and inform the workers and employers

GN-06 Third Party Actions
General Comments
There are a lot of pieces to this issue that need explanation; industries would appreciate any materials or question and answer documents to assist with understanding this policy
Gaps in the Policy Proposal
Section 4. No Right to Choose Whether to Sue or Claim Compensation:
- The wording could be a little clearer concerning the ‘application of the Act’; it sounds like there can never be a claim
Additional Comments
No feedback receivedOther Feedback Received
During the engagement additional feedback was received on aspects of the legislation and it is summarized here.Consistent feedback is that this policy does not address the challenges of the placer mining industry:
- The exceptions for vehicles is problematic because many placer miners have small planes that are used in the operation of the mine
